My Computer Club is a membership benefit and credit program that provides interest free financing for computer systems, personal and home electronics, and other services that are listed in our membership materials either in print or on our web sites.
Member services that shall be provided to you during the course of your membership may include but not limited to interest free financing of up to 80% on select pre-configured computer systems and other products listed in our member materials including but not limited to: tech support; convenient online shopping; promotional newsletters and other offerings that provide additional savings; toll free member services line and unlimited access to the My Computer Club Internet site.
DESCRIPTION OF
MEMBERSHIP: Membership is provided by My Computer Club, a DBA of Players
Vacation Club, Inc. a Nevada, US corporation and London, UK ltd. co. Membership
is available only to US residents who: agree to the terms and conditions
of our membership offering; qualify with a combined household income of
over $1,800 a month; has a valid US checking account; is over 18 years
of age; has proof of income for a minimum of 6 consecutive months; allow
the electronic debiting of Member's checking account via check-draft or
ACH; and has paid the necessary fees for enrollment. Membership shall
remain valid if: the annual membership fees are paid; the use of any credit
extended member has been paid in a timely fashion; and the personal and
financial information provided by the member remains accurate. Member
agrees that providing any incorrect or misleading information will result
in My Computer Club denying extension of credit.
Enrollment Fees -Your membership is effective immediately following your enrollment date. The initial payment of $44.50 will be charged immediately upon completion of the enrollment form. In 30 days your membership benefits will continue uninterrupted upon payment of the second $44.50 for a total of payments equaling $89.00 (your annual membership fee). All members agree to have their account of record automatically debt for membership fees required upon acceptance of these terms, as listed on the order form, and prior to financing approval on any product or service. PVC reserves the right to change the terms of the membership fee at any time and without notice.
Cancellation Policy: - You can cancel to stop
all future billings and your membership at anytime. Upon cancellation
any refund will be prorated and a refund will be issued based on the unused
portion of your annual fee calculated at $7.42 daily.
Any person(s) who have used the finance portion of this membership may not
cancel their membership during the any period of a year for which payments are
being made.To receive financing on our listed vacation packages we must receive
a 45 day advance notice from your travel dates. Special requests will be
considered.
Emails sent to My Computer Club are not answered by a live representative and will not be accepted as a valid form of canceling your membership. ANY MEMBER who has utilized My Computer Club financing to purchase any product may not cancel their membership during that period in which payments are required to be paid. Customer Service is available Monday - Friday 9am - 5pm (PST) or you may write us at Membership Services, 501 West Broadway, Plaza A, Suite 321 San Diego, CA 92101.
RENEWAL will be on an annual basis. Each year your annual dues will be automatically debited from your checking account on file with us, unless you notify us otherwise. A written notification and reminder will be mailed to you thirty (30) days prior to your renewal date. Upon renewal, you will be issued a new membership materials and continue to have access via the internet. This is known as a Continuity Plan. We reserve the right to increase or decrease the Renewal Fee for each new Membership Term.
TRADE UP & TRADE IN POLICY Members must be in good standing with us including no missed or late payments on previous agreements including but limited to Membership Agreement. A new purchase agreement must be signed prior to shipping new upgrade PC. Contract terms may vary based on upgrade model selected and trade in model used. Monthly payment and or deposit requirement may increase based on upgrade model chosen and trade in model used. My Computer Club reserves the right to refuse upgrade trade in if trade in PC is damaged or does not work to our satisfaction. All taxes and fees must be paid prior to shipping if applicable
FREE MONITOR PROMOTION This promotion is for members of My Computer Club begining November 4, 2008 and is available while supplies last. Members elegible for FREE monitor giveaway must be in good standing and purchase any CyberStar Intel Core 2 QUAD computer system from member web site. Free monitor will be 17" LCD, make and brand may vary depending on available supplies. Any shipping, handling and applicable sales tax cost are the responsibilty of the member and must be paid prior to shipping of product. My Computer Club reserves the right to end this promotion at any time and without notice.
SHIPPING The 14-day shipping guarantee does not apply to any PC where upgrades are added thus requiring additional installation time. Any advertised bundled system may not be shipped in 14 days due to the number of devices needed. The 14-day guarantee is limited to business days only and can total up to 21 calendar days.
My Computer Club is not liable for any damage to any product purchased incurred during shipping. All damage claims must be filed with the applicable shipping company.
Ship-To Prohibitions: Please be informed that your designated ship-to address must reflect the address on the Purchase Agreement. My Computer Club will not process any order that specifies an address of a freight forwarder, warehouse, and distribution center, airport, Hotel, PO Box or any address other than that of the buyer listed on the purchase agreement.
INTEREST FREE FINANCE TERMS: The amount of credit extended to each member shall not exceed $3,000 at any given time. Said credit issued is based on the pre-configured packages member purchases, then calculating the remaining balance after deducting the down payment. The credit limit does not function and is not intended to be used like a typical credit card. The credit limit and membership terms allow a member to make payments on their purchase interest free, potentially creating six months of good payment history with My Computer Club. If a six-month consistent payment history is reached, Member may then use any remaining balance for financing on additional purchases subject to our approval. Payment terms on all financed purchases are calculated dividing the balance remaining after required deposit has been paid and subtracted then from the total purchase price. The divided balance remaining shall be paid each month in equal parts and shall not incur any accumulated interest charge. The number of payments may vary depending on the total purchase price of the item selected and will be reflected on the promise to pay agreement.
Financing is issued on select products and services to Members who agree to have their checking accounts electronically debited for repayment of the credit extended on a monthly basis as listed in our membership materials. Payment terms range from 3 months to 18 months depending on the selected product or service; a separate promise-to-pay agreement between My Computer Club and the member will be sent for signature for each item financed by the member.
In our fulfillment materials, some of our products are only available for households that meet discretionary income requirements, i.e., Member must be above our minimum threshold levels to qualify for greater financing.
USAGE of member financing exists solely for the member listed on the
membership card and agreement. Member agrees that you will use My Computer Club financing only for your own behalf or the members of your immediate family residing in your household. My Computer Club reserves the right to ask for additional deposits if your membership payment history reflects negative activity (missed or late payments). Any fee's or product payment returned NSF or un-paid for any reason may disqualify you from any future financing.
ADVERTISEMENTS & PRODUCT DESCRIPTIONS: My Computers Club is not responsible for typographical errors or omissions. We reserve the right to change prices and products without notice or obligation.
Security Interest: My Computer Club, to the extent legally permissible,
retains a security interest in all merchandise charged on your account until the balance is paid in full.
Returned and NSF ACH Payments: In the event that any non-sufficient funds activity (NSF items), Member agrees that My Computer Club will attempt to collect the full amount again by presenting the ACH authorization a second time to your banking institution of record.
DEFAULT ON ACCOUNT: Member agrees that they will be in default if: (a) they fail to pay the " monthly payment" when due; or (b) if Member breaches any of the Terms and Conditions of the Purchase Agreement. If Member is in default, then in compliance with applicable law, My Computer Club has the right to: (a) demand member to pay the entire unpaid balance on the account immediately; (b) apply monies received on subsequent purchases to any delinquent account balance owed including late fees if applicable; and/or (c) proceed with legal action.
DELINQUENT ACCOUNT: Member's account is considered delinquent if the Monthly Payment is not received by My Computer Club when due. A $10.00 late fee may be charged against my account each month Member's account is overdue.
IDENTITY PROTECTION: All members financing any product or service may be required to provide to our finance department the following documentation for Identity, Residence and Employment verification purposes only:
· Photocopy of valid state issued drivers license or identification card
· Photocopy of your federally issued social security card.
· Photocopy of a current utility bill in your name and showing your current address.
· Photocopy of a current pay stub in your name and showing minimum of 6 months of employment.
· Photocopy of a current bank statement in your name and reflecting a positive balance.
Our underwriting department reserves the right to require the submittal of any additional forms of identification and or residential and employment documentation not stated here that it deems necessary to satisfy the above stated requirements for loan approval. If the documentation sent by you fails to satisfy these requirements to our satisfaction we reserve the right to refuse financing to anyone at anytime. The above requirements are meant to protect you the member and My Computer Club against identity theft and fraud.
Renewal occurs annually. Each year your annual dues will be
automatically debited from your checking account of record on file with us, unless you notify us five (5) business days prior to your renewal date. A written notification and reminder will be mailed to you thirty (30) days prior to your renewal date (to the address on file; it is the responsibility of the member to provide a new address to us when appropriate). Upon renewal, new membership materials will be re-issued. This is the Continuity Plan. We reserve the right to increase or decrease the Renewal Fee for each new Membership Term. Your membership is effective for a period of twelve months following enrollment date under the annual membership plan.
STATE NOTICES:
NOTICE FOR CALIFORNIA RESIDENTS: California law requires that we inform customers that should they fail to fulfill the terms of their credit
obligation, a negative report reflecting on their credit record may be
submitted to a credit-reporting agency. If you are married, you may apply for credit in your own name.
NOTICE FOR FLORIDA RESIDENTS: You (borrower) agree that, should we obtain a judgment against you, a portion of your disposable earnings may be attached or garnished (paid to us by your employer), as provided by Florida and Federal law.
NOTICE FOR OHIO RESIDENTS: The Ohio laws against discrimination require that all creditors make credit equally available to all creditworthy customers, and that credit reporting agencies maintain separate credit histories on each individual upon request. The Ohio Civil Rights Commission administers compliance with this law.
NOTICE FOR MARRIED WISCONSIN RESIDENTS: No Agreement, unilateral statement or court decree relating to marital property adversely affects a creditor's interest, unless prior to the time credit is granted the creditor is furnished a copy of the Agreement, statement or decree, or has actual knowledge of the adverse position.
